By scheduling service, purchasing equipment, or using the website www.aircityacandheating.com, you (“Customer”) agree to the following Terms & Conditions with Air City AC & Heating (“Company,” “we,” “our”).


1. Ownership & Payment

  • Air City AC & Heating retains ownership of all equipment, materials, and parts until full payment has been received.

  • Payment is due immediately upon completion of work unless otherwise agreed to in writing.

  • Late payments are subject to:

    • $100 late fee

    • 15% annual interest on outstanding balances

    • Attorney and collection fees, if applicable


2. Financing & Rebates

  • Financing is offered through third-party finance companies.

  • Qualification, approval, interest rates, and terms are determined solely by the financing provider. Air City AC & Heating does not guarantee financing approval.

  • All financing advertisements (including 0% APR promotions) are subject to lender approval and eligibility.

  • Rebates and promotional discounts are already applied to final pricing at the time of sale. Customers are not entitled to additional rebate cash or credits after purchase.

  • Any instant rebate advertised is reflected in the quoted or invoiced price.


3. Buy Back Program

  • Air City AC & Heating may offer a Buy Back Program on qualifying systems.

  • Eligibility, credit amount, and terms of the program are determined solely at the discretion of Air City AC & Heating and may vary based on system age, condition, and current promotions.

  • The Buy Back Program applies only when purchasing a new qualifying system through Air City AC & Heating.

  • The credited amount is applied toward the purchase price of the new system and cannot be redeemed for cash or transferred.

  • Air City AC & Heating reserves the right to modify or discontinue the Buy Back Program at any time without notice.


4. Liability & Risk

  • Customer must provide safe access for workers and ensure the workspace is clear.

  • Customer assumes risk of loss or damage to materials, tools, and equipment stored on-site.

  • Customer is responsible for maintaining appropriate property and homeowner’s insurance.

  • Air City AC & Heating is not liable for damages caused by:

    • Fire, water, electrical, or structural issues

    • Hidden, concealed, or unforeseen conditions outside of our control


5. Refunds & Restocking

  • All payments are non-refundable unless expressly approved in writing.

  • If cancellation occurs after materials have been ordered, a 15% restocking fee will apply.


6. Warranty & Maintenance

  • Manufacturer and labor warranties are provided as outlined at the time of purchase.

  • Warranty coverage requires regular preventative maintenance. Failure to maintain equipment may void warranty.

  • Extended labor or warranty coverage is valid only if maintenance is performed by Air City AC & Heating or an authorized provider.

  • Warranty exclusions include:

    • Service calls through home warranty providers

    • Poor installation or service performed by third parties

    • Pre-existing conditions


7. Service Guarantee

  • Air City AC & Heating guarantees that all work will be performed in a professional and workmanlike manner.

  • If an issue arises due to workmanship within the warranty period, Air City AC & Heating will correct the issue at no additional charge.

  • This guarantee does not cover:

    • Failures caused by pre-existing conditions

    • Work performed by third parties

    • Improper use, neglect, or lack of maintenance by Customer


8. Customer Responsibilities

  • Customer is responsible for all project costs, even if reimbursement is expected from a landlord, insurer, or third party.

  • Air City AC & Heating is not responsible for:

    • Damages caused by exposing plumbing or draining systems

    • Work beyond the original estimate unless approved in writing

    • Non-service items (concrete, driveways, flooring, roofing, landscaping, etc.)


9. Water Damage Waiver

  • Customer acknowledges the risk of water damage, mold, mildew, odors, and poor air quality if water-damaged materials are not removed.

  • Customer has been advised of these risks and assumes full responsibility for remediation if declined.


10. Legal Protection & Limitation of Liability

  • Customer releases Air City AC & Heating from liability for:

    • Consequential, incidental, special, or secondary damages

    • Pre-existing conditions or sediment buildup discovered during service

  • Air City AC & Heating’s liability shall not exceed the amount paid by Customer for the specific service provided.


11. Scheduling & Cancellations

  • Appointments must be scheduled in advance and are subject to availability.

  • Cancellations within 24 hours of a scheduled appointment may be subject to a fee.

  • Emergency services are prioritized but not guaranteed.


12. Use of Website

  • All website content, including logos, images, and text, are the property of Air City AC & Heating and may not be used without permission.

  • Prohibited activities include unauthorized access, data scraping, and misuse of contact forms.


13. Governing Law

  • These Terms & Conditions are governed by the laws of the State of Texas.

  • Any disputes shall be resolved in the courts located within Travis County, Texas.


14. Changes to Terms

  • Air City AC & Heating reserves the right to update these Terms & Conditions at any time.

  • The “Last Updated” date will be revised accordingly.
